Emberfall Frontier – Terms of Service
These terms apply to the mobile game Emberfall Frontier (“the game”), published by Lucas Capital Partners, LLC, doing business as Carbon Gamer (“we”, “us”). By installing or playing the game you agree to them. If you do not agree, please do not play. Questions: team@lucascapitalpartners.com.
1. Who can play
You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. You may hold one account per person, and you are responsible for what happens on it. Keep your sign-in details private.
2. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to play the game for your own non-commercial entertainment. The game, its art, characters, names, code and content belong to us or our licensors. You may not copy, sell, modify, reverse engineer or redistribute the game, except where the law expressly allows it.
3. Virtual items
Resources, Embers, speed-ups, troops, commanders and other in-game items (“virtual items”) are part of the game. They have no real-world value, cannot be exchanged for money, and may not be sold, traded or transferred outside the game. You have a licence to use them in the game; you do not own them. We may rebalance or change virtual items to keep the game fair and working.
4. Purchases
If the game offers in-app purchases, they are processed by Google Play under Google’s terms. Prices are shown before you buy. Purchases are final once the item is delivered, except where the law or Google Play’s refund policy says otherwise. If something you paid for does not arrive, contact us and we will put it right.
5. Fair play and conduct
Emberfall Frontier is built to be fair. When you play, you agree not to:
- cheat, use bots, scripts, modified clients, or exploit bugs (please report bugs to us instead);
- buy, sell or trade accounts or virtual items for real money, or use more than one account to gain an advantage;
- harass, threaten, bully or impersonate others, or post hateful, sexual, violent or illegal content in chat, names or alliance text;
- share other people’s personal information, or spam or advertise;
- attack, overload or try to get unauthorised access to our servers or other players’ accounts.
Attacking other players’ bases, gathering, and taking the Capital are part of the game and are not misconduct.
6. What you post
You are responsible for the names and messages you create. You give us permission to store, display and moderate them so the game can work. We may remove content or rename commanders and alliances that break these terms.
7. Enforcement
If you break these terms we may warn you, remove content, reset progress gained unfairly, or suspend or close your account. We will act proportionately, and you can contact us if you believe we made a mistake.
8. Changes and availability
The game is a live service. We update it, change features and balance, and may run test or seasonal worlds. The game needs an internet connection, and we cannot promise it will always be available or error-free. If we ever shut the game down, we will give at least 60 days’ notice in the game.
9. Ending your account
You can stop playing and delete your account at any time. How we handle your data is explained in the privacy policy.
10. Disclaimers and limits
To the extent the law allows, the game is provided “as is”, without warranties of any kind, and we are not liable for indirect or consequential losses, or for loss of virtual items. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or US $50 if you paid nothing. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.
11. Law and disputes
These terms are governed by the laws of the United States and of the state in which Lucas Capital Partners, LLC is organised, without regard to conflict-of-law rules. If you live in the European Union or the United Kingdom, you also keep the protections of the consumer law of your country and may bring claims in your local courts. Before starting any legal claim, please contact us first so we can try to resolve it.
12. Changes to these terms
We may update these terms. We will change the date above and, for significant changes, tell players in the game before they take effect. If you keep playing after that, the new terms apply.
